The same applies to any combination or conjunction with any other trademark, symbol, logo, or any other distinctive sign intended to form a composite logo. ARTICLE 4: LIMITATION OF LIABILITY

ARTICLE 5: APPLICABLE LAW AND JURISDICTION These General Terms of Use are governed by Swiss law. In the event of a dispute concerning the interpretation, execution, or validity of these General Terms of Use, the parties agree to submit the dispute to the competent Swiss courts. If there is a discrepancy between the French version and the translated version of these General Terms of Use, the French version will prevail.
ARTICLE 5: USER OBLIGATIONS
The user shall undertake not to: (a) utilize or permit the utilization of the Site in an abusive, unlawful, fraudulent, or malicious manner, including but not limited to: (i) engaging in hacking activities against the Site or introducing malicious code, including viruses or harmful data, into the Site or any operating system; (ii) employing spiders or any other automated or non-automated system, device, or program to extract data or information from the Site or the servers of BERR & PARTNERS S.A.; (iii) transmitting or storing documents containing viruses, worms, Trojan horses, or any other harmful computer codes, files, scripts, agents, or programs; (iv) interfering with or compromising the integrity or performance of the Site and its contained data; (v) attempting unauthorized access to the Site, its systems, or associated networks; (vi) seeking unauthorized access to the accounts or personal information of other users.
ARTICLE 6: LIMITATION OF LIABILITY
BERR & PARTNERS S.A. does not provide any warranty regarding the suitability of the Site’s content for all countries or its availability for use in all countries. Users shall ensure compliance with the applicable regulations in their respective countries, as the access to the Site’s content may be deemed illegal for certain individuals or in certain jurisdictions. The waiver by BERR & PARTNERS S.A. to enforce any provision of these Terms shall not be construed as a waiver to enforce any other provision of these General Terms of Use.
This limitation of liability shall apply to the maximum extent permitted by law.
ARTICLE 7: MAINTENANCE, AVAILABILITY
BERR & PARTNERS S.A. shall use its best endeavors to maintain a reasonable level of operation and availability of the Site. BERR & PARTNERS S.A. reserves the right, at any time and without prior notice, to restrict the access and usage of the Site by the user in order to perform maintenance operations or effectuate modifications. BERR & PARTNERS S.A. shall not be held liable for any interruption of access due to such maintenance or update operations.
